Regulations of the Culinary Workshops Przystanek 11

I INTRODUCTION

  1. These Regulations (hereinafter referred to as the Regulations) define the rules of organizing the Culinary Workshops. 2.

The Organizer of the Culinary Workshops (hereinafter referred to as the Culinary Workshops) is Danuta Cebeterewicz-Goliwąs who runs a business under the name Przystanek11 Danuta Cebeterewicz-Goliwąs with its registered seat in Zabrze (41-810), Paderewskiego 11 Street, entered into the Central Register of Registration and Information on Business Activity, using Tax Identification Number: 647-164-61-76 and Business Identification Number: 528150535 (hereinafter referred to as the Organizer).   3. By applying for participation in the Culinary Workshops, the Participant accepts the provisions of the Rules and Regulations. Non-compliance with the Terms and Conditions by the Participant may result in exclusion from the Culinary Workshops. 4.
  4. The Terms and Conditions are an integral part of the Culinary Workshops participation application (hereinafter referred to as the Participation Application) and are binding on every Participant.

II GENERAL PROVISIONS

1. Participation in the Culinary Workshops requires applying for participation and paying a fee in the amount specified by the Organizer. 2.

2. The Organizer organizes Culinary Workshops for adults and children. Children participating in the Culinary Workshops are the responsibility of their guardians. 3.

3. The Culinary Workshops are organized at the Organizer's headquarters, at a culinary studio Przystanek11 in Zabrze (41-810), Paderewskiego 11 Street or at any other place designated by the Organizer.

4. The Culinary Workshops are conducted in Polish, unless another language is indicated in the description. 5.

5. The number of Participants taking part in the Culinary Workshops is limited.

6. Each Culinary Workshop topic is described in detail. The description includes: workshop topic, names of dishes, instructor, venue, date, time, duration, gross price.

7. The Organizer reserves the right to prolong or shorten the Culinary Workshops in order to allow the Participants to perform the planned dishes. 8th The Culinary Workshops have a character of a culinary workshop.

8. Culinary Workshops are of practical nature. The Organizer ensures that the Participants are provided by the leader with the knowledge about the prepared dishes and practice preparing the dishes indicated in the description of the Culinary Workshops. The Organizer is not responsible for the extent to which knowledge and skills will be acquired by the Participants. 9.

9. Only persons who have paid the fee are allowed on the premises where the Culinary Workshops are held, and in the case of children in need of supervision, also their guardians.

10. A participant who is late for the Culinary Workshops participates from the moment of his/her arrival at the Culinary Workshops. The leader is not obliged to repeat the previously conducted part of the classes.

11. In case of recording the Culinary Workshops with audio and video recording devices by a person authorized to do so by the Organizer, the Participant agrees to do so without any claims. The Culinary Workshops Participant (or his/her guardian), before the beginning of the Workshops, agrees in writing to use his/her image in case of publishing photos and films on the Internet by the Organizer and its partners.

III OBLIGATIONS OF THE ORGANIZER

1. The Organizer shall make every effort to carry out the Culinary Workshops program.

2. The organizer will carry out technical and sanitary supervision of the place where the Culinary Workshops are held.

3. The Organizer appoints a person/s to conduct the Culinary Workshops. The person(s) conducting the Culinary Workshops is prepared to conduct the workshops, has knowledge and skills in the area in which he/she conducts the classes.

4. The leading person has a current medical certificate for sanitary-epidemiological purposes. This certificate confirms that its holder has provided medical examination and was found not to be suffering from any infectious disease and no contraindications to work with food.

5. The Organizer informs that to prepare dishes during the Culinary Workshops products are used that may cause allergic reactions in some people (e.g. almonds, fish, gluten, etc). Each Participant, knowing their health condition and agreeing to participate in the Culinary Workshops, agrees to take this factor into account.

6. The Organizer is not responsible for:

- actions and omissions made by the Participant during the Culinary Workshops,
- material damages or damages to the Participants' health during the Culinary Workshops caused by the actions or omissions of the Participants,
- damages which are the result of infringing the rights of third parties by the Participants
- for any consequences of accidents occurring during the Culinary Workshops.

7. The Organiser shall not be liable to the Participant for any failure to perform any obligations under these Regulations to the extent caused by the occurrence of "Force Majeure", i.e. an event beyond the Organiser's control, including but not limited to: fortuitous event, war, uprising, riot, acts of terrorism, fire, explosion, flood, theft of essential equipment, wilful damage, cyber attack, strike, lock-out, weather conditions, security for the benefit of a third party, requirements arising from the defence of the country, acts and regulations of state or local government authorities.

IV PARTICIPANT'S RESPONSIBILITIES

1. The participant is obliged to follow the instructions of the leader of the Culinary Workshops and safety rules in force at the place of the Culinary Workshops.

2. Participant working in contact with food should maintain a high degree of personal cleanliness and wear a protective outer garment (apron). It is important to take care of long hair, so that it does not come into contact with food.

3. Participant is obliged to inform the Organizer about any contagious diseases (e.g. jaundice) of which he/she is aware, as well as about any allergies and health contraindications that may affect his/her health during the Culinary Workshops in which he/she participates.

4. The participant shall keep their workspace and the equipment and devices they use during the Culinary Workshops clean.

5. The participant uses all home appliances according to their instructions for use.

6. The Participant is responsible for any damage caused during the Culinary Workshops to themselves or other Participants, which are the result of their negligence or careless/reckless or reckless behaviour.

7. The person operating the equipment, tools or devices is responsible for the destruction or damage to them.

8. Participant is not allowed to use their own food products, beverages or tools during the Culinary Workshops, unless the Organizer agrees.

V CHILDREN'S COOKING WORKSHOP

1. Culinary Workshops for children are organized without the presence of adults, except for II.9 (when the child needs adult supervision).

2. The child is brought to the studio by an Adult supervisor and picked up after the class is over. If the child can leave the studio on his/her own, it is necessary to provide a statement from the child's Adult Guardian.

3. Before the beginning of the Culinary Workshops, the person conducting the workshop discusses the principles of safety and health, safe use of kitchen tools and equipment. He/she talks about the dangers of using a hot oven, baking trays, hobs and pots.

4. Children are prohibited from: running around the culinary studio, using chef's knives.

5. Adult guardian of the child is responsible for improper behavior, improper use of kitchen equipment and tools, which may result in injury, cut, burn the child.

6. The Child's Adult Caregiver is responsible for any damage or destruction of equipment, tools or appliances.

VI PURCHASE OF THE SERVICE

1. Participant shall apply for participation in the chosen Culinary Workshop and date of the Culinary Workshops by sending an email to kontakt@przystanek11.pl or by filling in the registration form found on the website www.przystanek11.pl.

2. The application includes the following data: name and surname, name/theme of the workshop, date. If the Participant reserves more than one place - he/she shall specify the number of places in the application form. 3.

3. By sending the application the participant declares that the data provided is complete and consistent with the facts, agrees to the inclusion of the personal data in the database and their processing for the purpose of carrying out and handling of the order by the Organiser, who is also the data administrator, in accordance with the provisions of the Act of 29 August 1997 on the protection of personal data. Personal data contained in the Organizer's database shall not be transferred to other entities. The personal data provided by the Participant (name and surname, address, phone number, e-mail address) is treated as confidential information and is used only for the purposes of communication between the Participant and the Workshop Organiser.

4. The Organizer then confirms the reservation by sending an email to the Participant. In the body of the email the Organizer will provide detailed information needed to make the payment.

5. The reservation is valid for a period of 3 days. During this time one should make a money transfer for the participation in the Culinary Workshop. The "title" of the transfer should include your first and last name, date and name of the Workshop. The transfer is also possible on 516 086 669.

6. The purchase of services takes place after the Participant makes a payment to the Organizer's bank account. Prices of all Culinary Workshops are gross prices per person. 7.

7. Participant purchasing the participation in the Culinary Workshops accepts the principles of their organization described in detail in the Terms and Conditions located on the website: www.przystanek11.pl.

8. The Organizer's bank account number: 42 1050 1298 1000 0090 8366 9045 .

9. Lack of payment within the required period of 3 days from receiving the email means that the Participant has resigned from participating in the Culinary Workshops and treats the initial reservation as invalid. By the same token, it authorizes the Organizer to cross the Participant off the list of Workshop Participants.

10. The order of applications and payments decides about the participation in the Culinary Workshops. 11.

11. The Organizer has the right to apply discounts from the price given for the Culinary Workshops.

The participation fee for the Culinary Workshops includes:

- group classes with the instructor,
- all the food necessary to prepare the dishes,
- use of all kitchen equipment in the Culinary Studio,
- recipes of the dishes included in the workshop,
- water, coffee and tea for use during the Culinary Workshops (or other beverages included in the Culinary Workshops description).

VII RESIGNATION , CANCELLATION OF WORKSHOPS

1. The Participant has the right to resign from the paid Culinary Workshops. This does not apply to gift certificate holders.

2. Resignation notice must be submitted in writing, not later than 7 days before the date of the Culinary Workshops to the e-mail address: kontakt@przystanek11.pl. In the body of the message a person is obliged to give his/her name and surname as well as the date of the classes he/she is resigning from.

3. The payment for the Culinary Workshops is refunded by transfer to the account from which the payment was made within 7 days from the date of resignation.

4. In the case of notifying the Participant of the cancellation less than 7 days before the date of the Culinary Workshops, i.e. from 6 days to 4 working days, the Participant shall bear the cost of the reservation fee amounting to 30% of the fee. The remaining part of the fee is refunded to the account from which the payment was made within 7 days from the resignation date. 5.

5. In case of notifying the Participant of the cancellation within 3 to 2 days before the date of the Culinary Workshops, the Participant will bear the cost of the reservation fee, the costs associated with the purchase of products and conducting classes, which constitutes 70% of the fee. The remaining part of the fee is refunded to the account from which the payment was made within 7 days from the resignation date. 6.

6. In case of notifying the resignation of the Participant within 1 day before the date or on the date of the Culinary Workshops - the payment made will be lost.

7. The Organizer has the right to cancel the classes. One of the most common reasons for the cancellation of the Workshops is the insufficient number of registered Participants for the given date of the Workshops. When cancelling the Workshops, the Organizer may offer the Participant another date of the Culinary Workshops or another subject of the Culinary Workshops. If the Participant does not agree to the change, the Organiser shall refund the fee paid by the Participant immediately, but no later than within 5 days.

VIII VOUCHERS

1. The Participant may purchase a gift vouchers.

2. Gift vouchers are available at the following prices: PLN 90, PLN 150, PLN 250 or at any other price the Participant decides.

3. The gift voucher may be purchased for a specific workshop - in this case, the subject and date of the workshop shall be indicated on the voucher. The participant of the workshop who has received the voucher is obliged to attend the indicated workshop.

5. The recipient signs up for the Culinary Workshops according to the timetable at www.przystanek11.pl/main/warsztaty. He/she enters the gift certificate number in the notes on the form.

6. Payment for the Culinary Workshops is made with the gift certificate. When the value of the gift certificate is consistent with the price of the Culinary Workshops - the Participant does not pay anything extra. In other cases - when the price of the Culinary Workshops is higher or lower than the price of the gift certificate - the Organizer decides how to redeem the gift certificate.

7. In the case of a workshop with a higher value than the value of the gift certificate, it is possible for the Participant to make an additional payment to the value of the workshop. The Organiser shall not refund or in any other way reimburse the difference between the price of the workshop and the price of the gift certificate.

8. The gift certificate is numbered and issued/sent after payment for it.

9 It is not possible to refund an unused gift certificate.

10 Each gift certificate can be used until the amount has been used in full.

11. The gift certificate (without an indication of the topic and date of the Culinary Workshops) is valid indefinitely, with the reservation that it can only be used by one person. The Participant has to present the gift certificate before the Culinary Workshops start.

X CONDUCT AND ORGANISATION OF THE WORKSHOP DURING THE EPIDEMIC

1. Each participant declares to be healthy (not infected with SARS-COV-2 virus) and not in quarantine or under epidemiological surveillance.

2. Each participant declares that if they develop symptoms of COVID-19 infection within 10 days of participating in the cooking workshop, they agree to
immediately inform about this fact the appropriate local sanitary and epidemiological services, as well as the Organizer at the following email address: kontakt@przystanek11.pl and take the necessary steps as indicated by GIS https://www.gov.pl/web/koronaw.... 3.

3. The participant is obliged to follow the sanitary regime concerning the rules of safe operation during the cooking workshops during the COVID-19 outbreak.

4. The participant shall be provided with and wear a mask/ visor, excluding children.

5. Participant starts working after washing hands with soap and water and regularly repeats this activity throughout the workshop.

6. The participant uses the alcohol-based disinfectant provided. Disposable gloves are available.

7. The participant maintains a safe distance of 1.5 meters from other participants. 8.

8. Before each workshop, all usable surfaces are disinfected: handles, countertops, etc. The room is ventilated.



X FINAL PROVISIONS

1. The Organiser reserves the right to change the Regulations at any time. The change does not apply to Participants who have previously purchased participation in the Culinary Workshops and accepted the Regulations, unless they agree to such a change.

2. Any disputes that may arise from the participation in the Culinary Workshops will be settled by a court with jurisdiction over the Organizer's headquarters. 3.

3. In matters not covered by these Regulations, the provisions of the commonly applicable law shall apply, including in particular the provisions of the Civil Code, the Act of 30 May 2014 on consumer rights.

4. Participant on the right to make a complaint. The complaint must be submitted in writing to the e-mail address: kontakt@przystanek11.pl. The Organiser will consider the complaint within 10 working days and will notify the Participant of the consideration of the complaint to the email address from which the complaint was sent.
